Respondents Prayer : Writ Petition is filed under Article 226 of the Constitution of India, pleased to issue a Writ of Mandamus, directing the respondents 1 and 2 to forthwith give necessary Police Protection to the petitioner and his family members so as to enable the petitioner to cultivate and enjoy the properties of the petitioner in Survey Nos.21/7B, 23/4A, 23/6, 24/3 and 24/4 situated at Pallipattu Village, Virudhachalam Taluk, Cuddalore District by considering and passing necessary orders on the complaint of the petitioner dated 09.01.2024 and the representation of the petitioner dated 01.03.2024.

O R D E R

This writ petition has been filed to direct the the respondents 1 and 2 to forthwith give necessary Police Protection to the petitioner and his family members so as to enable the petitioner to cultivate and enjoy the properties of the petitioner in Survey Nos.21/7B, 23/4A, 23/6, 24/3 and 24/4 situated at Pallipattu Village, Virudhachalam Taluk, Cuddalore District by considering and passing necessary orders on the complaint of the petitioner dated 09.01.2024 and the representation of the petitioner dated 01.03.2024.

2.Heard learned counsel for petitioner and learned Additional Public Prosecutor appearing on behalf of the 1st & 2nd respondents. 3.Learned Additional Public Prosecutor appearing for respondent police submitted that the representation made by the petitioner is not available with the respondents. Learned Additional Public Prosecutor further submitted that if fresh representation is made by the petitioner, the same will be enquired and a decision

will be taken with regard to providing police protection. 4.Considering the submissions made by learned Additional Public Prosecutor, there shall be a direction to the petitioner to give a fresh representation to the 2nd respondent. The 2nd respondent, on receipt of the same, shall conduct an enquiry by issuing notice to all the interested parties and also in line with the decree passed in I.A.No.248 of 2009 in O.S.No.5 of 2008 passed by the learned Principal Sub Court, Vridhachalam and take a decision within a period of four (4) weeks.
