ORDER : The Court Made the following order :- This Criminal Original Petition has been filed praying to grant Anticipatory Bail to the petitioners.
2. A case has been registered against the petitioners by the respondent police in Cr.No.311 of 2018 for the offence under Sections 147, 448, 294(b), 323, 386 and 506 (i) IPC.
3. According to the defacto complainant, the petitioners had forced the defacto complainant, his son and his family members to pay the amount defrauded by the son and they were beaten by wrongfully restraining them.
4. The learned Senior counsel appearing for the petitioners contend that the son of the defacto complainant defrauded to the tune of Rs.39,90,000/- from the construction concern VGN Infra India Pvt., Ltd., where he was working as Accountant and the petitioners are employees in that company. On the complaint given by the company, a
case was registered against the son of the defacto complainant and this case has been filed against the petitioners as counter blast. The petitioners are having permanent residence and therefore they may be granted Anticipatory Bail.
5. The learned Additional Public Prosecutor opposes for grant of Anticipatory Bail.
6. Considering the arguments made by the learned Senior counsel appearing for the petitioners, the fact that the petitioners are having permanent residence and pendency of the counter case against the son of the defacto complainant and also the facts and circumstances of this case, this Court is inclined to grant Anticipatory Bail.
7. Accordingly, all the petitioners are ordered to be released on bail in the event of arrest or on their appearance before the learned Judicial Magistrate No.I, Poonamallee and on their executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) each with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition to appear before the respondent police every Monday at 10.00 a.m for a period of three weeks and thereafter, as and when required for interrogation. The petitioners shall comply with the condition stipulated under Section 438 Cr.P.C scrupulously.
8. The petitioners shall appear before the concerned Judicial Magistrate within a period of three weeks from the date on which the order copy is made ready, failing which, the petition for anticipatory bail stands dismissed.
