Writ petition filed under Article 226 of the Constitution of India praying for issuance of a writ of mandamus directing the respondents to provide the electricity connection to the petitioner's house situated at Door No.53, Mullai 1st Street, JJ Nagar, Annaikattucherry, Chennai 72, within a time frame. By consent, the writ petition itself is taken up for final disposal.
2.The petitioner claims that she is the lawful owner of the property comprised in Survey No.53, situated at Annaikattucherry Village, Poonamallee Revenue Taluk, Tiruvallur District, which was purchased by her by means of a registered sale deed dated 4.11.2009, and claims to be in continuous possession and enjoyment of the same. According to the petitioner, she approached the third respondent by submitting an application dated 19.5.2015, seeking domestic electricity service connection, and since she has not been favoured with any kind of response, came forward to file this writ petition. 3.The learned Counsel appearing for the petitioner, would submit that the electricity service connection is a minimum basic necessity and therefore, the third respondent is bound to consider and grant service connection.
4.Mr.P.Gunaraj, learned Counsel, who accepts notice on behalf of the respondents, would contend that the property is a Government Poramboke land, and however, the application submitted by the petitioner, would be disposed of in a time bound manner. 5.Though the petitioner prayed for a larger relief, this Court, in the facts and circumstances, directs the third respondent to consider and dispose of the petitioner's application dated 19.5.2015, on merits and in accordance with law, after putting the concerned persons on notice, within a period of four weeks from the date of receipt of a copy of this order and communicate the decision taken, to the petitioner as well as to the persons concerned. The writ petition is disposed of accordingly. No costs. Consequently, connected miscellaneous petition is closed.
