Writ Petition filed under Article 226 of the Constitution of India, praying for issuance of a Writ of Mandamus to direct the respondents 1 to 3 herein to consider the petitioner's representation, dated 22.01.2019 and remove the illegal encroachments by the respondents 4 to 14 in Survey Numbers 38, 1055, 1056, 1060, 1061, 1068, 1069, 1070, 1077, 1087, 1088, 1090, 1093, 1095, 1096 and 1097 of Rangampatti Revenue Village, Pochampalli Taluk, Krishnagiri District.

ORDER

(The Order of the Court was made by The Honourable Chief Justice) The Writ Petition was filed to seek a direction to the respondents to remove the encroachment. In pursuant to the representation, dated 22.01.2019 made by the petitioner, the respondents 1 to 3 have initiated action and the additional counter affidavit has been filed by the third respondent, which shows not only the action taken to remove the encroachment, but also the encroachment actually being removed. The photographs have been enclosed to show the aforesaid. Accordingly, we find that the encroachments have been removed and accordingly, the Writ Petition is disposed of, rendering it to be infructuous. However, it is with liberty to the petitioner to make an application to recall and revival of the Writ Petition if any encroachment still remains or the encroachment is made again, but it should be within a period of one month from today.
