Respondents Prayer:- Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure to direct the respondents not to harass the petitioner on the basis of the complaint dated 09.07.2016 preferred by Mrs.Hamsa to the 1st respondent which was subsequently forwarded to the 2nd respondent. ORDER

This Criminal Original Petition has been filed to direct the respondents not to harass the petitioner on the basis of the complaint dated 09.07.2016, given by the petitioner.

2. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondents.

3. On a complaint given by Hamsa, wife of the petitioner, petition enquiry is pending against the petitioner. Under such circumstances, blanket order of 'not to harass' cannot be passed. The petitioner shall co-operate for the enquiry and during the course of enquiry, he shall not be harassed. https://hcservices.ecourts.gov.in/hcservices/

However, if any cognizable offence is made out, this order would not be a shield against the arrest of the accused. With the above observation, the Criminal Original Petition is disposed of.
