Writ petition filed under Article 226 of the Constitution of India praying for issuance of a writ of mandamus directing the respondents to permit the petitioner to shift the Hindu Aided Middle School from Marady to Perumal Malai Adivaram, by considering the representation dated 17.1.2014, made by the petitioner. By consent, the writ petition itself is taken up for final disposal.
2.The Secretary of the petitioner-School filed the affidavit in support of the writ petition and would state that a teacher, who has joined the School on account of migration of a post, https://hcservices.ecourts.gov.in/hcservices/
started giving trouble and therefore, the management of the school decided to hand over the school to the Government and a representation has also been made; however, the Maradi villagers insisted the management to run the school as it would benefit them; but, the management of the school continues to receive threat and intimidation from the concerned person and therefore, it was constrained to submit a representation dated 17.1.2014, praying for appropriate permission for shifting the school from Marady to Perumal Malai Adivaram and the queries raised by the Educational Authorities, have also been replied and since no orders have been passed, the petitioner came forward to file this writ petition. 3.Heard the submissions of Mr.C.Selvaraju, learned Senior Counsel appearing for the petitioner, and Mr.Rm.
Muthukumar, learned Government Advocate, who accepted notice for the respondents. 4.This Court, without going into the merits of the claim projected by the petitioner, directs the first respondent to consider and dispose of the petitioner's representation dated 17.1.2014, in accordance with law, within a period of four weeks from the date of receipt of a copy of this order and communicate the decision taken, to the petitioner. The writ petition is disposed of accordingly. No costs.
