Petitions praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to [i] grant the extension of time to execute the Hon'ble Court order in Crl.OP.No.2809 of dated 17.02.2021.
[CRL.MP.NO.6931/2021] [ii] modify the condition(a) that petitioner is directed to deposit original title deed of immovable property worth Rs.5,00,000/- imposed by Hon'ble Court order in Crl.OP.No.2809 of 2021 dated 17.02.2021. [CRL.MP.NO.6932/2021] Order : These petitions coming on for orders upon perusing the petitions and the filed in support thereof and upon hearing the arguments of M/S.S.NEDUNCHEZHIYAN, Advocate for the Petitioner [IN BOTH THE PETITIONS] and of M/S. V.J.PRIYADARSANA, Government Advocate (crl.side) on behalf of the Respondent [IN BOTH THE PETITIONS] the court made the following order:- These petitions have been filed to grant the extension of time and to modify the condition (a) that petitioner is directed to deposit original title deed of immovable property worth Rs.5,00,000/- imposed by this Court by an order dated 17.02.2021 in Crl.O.P.No.2809 of 2021.
2.The learned counsel for the petitioner submits that this Court, while granting the anticipatory bail to the petitioner by an order dated 17.02.2021, had directed the petitioner to deposit original title deed of immovable property worth Rs.5,00,000/- which stands either in her name or the name of her friends or relatives to the credit of Crime No.9 of 2020 within a period of fifteen days from the date of receipt of a copy of this order.
3.The learned counsel for the petitioner further submits that despite the efforts taken by the petitioner, she was unable to get a document and none of her friends and relatives were ready to give their documents as surety to her. However, he would further submits that the petitioner prepared to deposit cash of Rs.2,00,000/- to the credit of Crime No.9 of 2020 in lieu of depositing of original title deed. Therefore, he seeks modification.
4.Heard both sides.
5.Considering the abovesaid submissions, the condition imposed by this Court on 17.02.2021 in Crl.O.P.No.2809 of 2021 is modified to the effect that the petitioner is directed to deposit cash of Rs.2,00,000/- in lieu of depositing of title deed worth Rs.5,00,000/- to the credit of Crime No.9 of 2020 within a period of three weeks from the date of receipt of a copy of this order and rest of the conditions imposed in Crl.O.P.No.2809 of 2021 remains unaltered. No further extension of time will be granted.
