2. The learned counsel for the appellant submitted that the appellant has filed a guardian O.P. on the file of the Principal District Court, wherein the said petition was dismissed vide order dated 12.06.2018. Challenging the same, the present appeal has been filed by the appellant herein.
3. Today, when the matter is taken up for hearing the learned counsel for the respondent did not choose to appear before this Court. This Court vide order dated 10.11.2023 issued a direction to the District Legal Services Authority, Namakkal to interact with the respondent who is residing in Sri Lankan refugee Camp as to whether she is inclined to contest the case by appointing a legal aid counsel and to that effect file a report before this Court on 22.11.2023, pursuant to which, the Secretary, District Legal Services Authority, Namakkal submitted a report to that effect stating that the respondent residing in Sri Lanka Refugee Camp is not willing to contest the abovesaid case and also that she is in good terms with her husband 2/4
4. In view of the above settlement arrived between the parties nothing survives for adjudication in the present appeal and this civil miscellaneous appeal is closed. No costs. Consequently, connected miscellaneous petition is closed.
