PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus directing the respondents to demarcate and survey the free house sites allotted to the petitioners having Nos.63 to 70 in S.No.350/ 1B and 351/1B, Sellamudi Village, Manjarahalli Post, Pennagaram, Taluk and Dharmapuri District by considering the representations dated 30.07.2024 and 07.10.2024 made by the petitioners. By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself.

The present writ petition is filed praying for a writ of Mandamus directing the respondents to demarcate and survey the free house sites allotted to the petitioners having Nos.63 to 70 in S.No.350/ 1B and 351/1B, Sellamudi Village, Manjarahalli Post, Pennagaram, Taluk and Dharmapuri District by considering the representations dated 30.07.2024 and 07.10.2024 made by the petitioners.
3. It is submitted by the learned counsel for petitioners that the petitioners do not own any house and have been alloted free house site in Survey No.350/1B 2/6
and 351/1B situated in Sellamudi Village, Manjarahalli Post, Pennagaram Taluk, Dharmapuri District. However, there is a need for survey and demarcation of the free house site alloted to the petitioners. The petitioners had submitted a representation on 30.07.2024 requesting demarcation of the free house site, however, the same has not been considered by the respondents till date. Hence, this writ petition.

At the outset, Mr.A.Selvendran, learned Special Government Pleader for respondents would submit that the respondents would conduct survey and demarcate boundaries at the free house site allotted to petitioners, within the time period stipulated by this Court, which was readily accepted by the learned counsel for petitioners.
5. In view thereof, the writ petition stands disposed of with a direction to the appropriate respondent to consider the representations dated 30.07.2024 and 07.10.2024 on its own merits and pass appropriate orders in accordance with law, after affording reasonable opportunity of hearing to the petitioners, adjacent land owner and any other interested persons/stake holders, including rival claimants, if any, within a period of eight (8) weeks from the date of receipt of a copy of this order. It is made clear that this Court has not expressed any views 3/6
with regard to the merits of the representations and it is open to the concerned respondent to consider the representations on its own merits and in accordance with law. No costs.
