COMMON JUDGMENT (Judgment of the Court was delivered by K.Govindarajan Thilakavadi J.) The appellant / National Highways Authority of India ('NHAI' for short) is before this Court in these appeals assailing the common judgment dated 24.11.2023 passed by the Principal District Judge, Tiruppur in petitions filed under Section 34 of the Arbitration and Conciliation Act, 1996 ('Act 1996' in short). The said petitions, under Section 34 of Act, 1996, were filed by NHAI assailing the award passed by the sole Arbitrator/District Collector, Tiruppur, granting solatium, interest to the lands acquired under the National Highways Act.

2.The learned District Judge, in the order dated 24.11.2023 confirmed the award passed by the sole Arbitrator / District Collector, Tiruppur granting solatium/interest and had also enhanced the compensation. The appellant/NHAI, claiming to be aggrieved is before this Court, the private respondent herein are the land owners, would be referred to as the 'claimants' hereinafter. The claimants are the owners of the different extent of lands in the __________Page 33 of 50

various survey Numbers which were all part of the same acquisition which was initiated under the preliminary notifications issued under the National Highways Act, ('NH Act' in short).

3.The appellant/NHAI is developing road infrastructure in the Nation. Considering the enormous increase in the vehicle traffic and to reduce fatal accidents besides property loss of the road users owing to the road accidents, the Government of India is implementing the projects through NHAI constituted under 1988 Act. As part of the projects the PIU Coimbatore has been embarked upon the task of implementing the project by name Chengapalli to Walayar Section NH-47. Land Acquisition Proceedings were initiated under NH Act, and of lands were acquired for formation of six laning under NH-47 in Pongalur Village, Palladam Taluk of Tiruppur District and in adjoining Villages. In this regard, 3A(1) Notification was published and the substance of the Notification was published in local dailies under Section 3A(3) of the Act calling of objections in the manner prescribed in Tamil Local daily as well as in English Local daily.

4.The Notification in connection with the same, under Section 3D(1) was approved and 3G(3) Public Notice was also published in Tamil Local daily and in English Local daily. 3G(3), enquiry was conducted at the office of the Special Tahsildar Land Acquisition, Palladam . The SDRO (LA) had fixed __________Page 34 of 50

the market value of the lands after considering the sales occurred within a radius of 1.6 Kms covering Pongalur Village. The SDRO (LA) has fixed values for the lands under acquisition and passed the Award. 5.Being aggrieved over the value fixed by the SDRO (LA) the claimants have filed Arbitration Petitions before the Sole Arbitrator /District Collector, Tiruppur seeking for enhancement of compensation. The District Collector after conducting enquiry with the appellant/NHAI along with SDRO (LA) had rejected the enhancement applications filed by the Appellant/NHAI on the ground that the award passed by the SDRO (LA) and the value fixed for the land is in a judicious manner and had held that all procedures were followed that were prescribed under NH Act, 1956.

However, while disallowing the enhancement claim, the District Collector had relied upon the Judgment passed in Tarsem Singh Vs. Union of India by the Hon'ble Supreme Court, wherein the Hon'ble Supreme Court ordered payment of 30% solatium along with interest in respect of the lands acquired. Based on the said judgment, the District Collector ordered for payment of 30% solatium and the interest. The said amount was ordered to be paid together with interest. 6.Being aggrieved by the said order passed by the District collector, the Arbitration OPs have been filed by the appellant /NHAI under Section 34 of the Arbitration Act.

7.The learned Principal District Judge while confirming the award granting solatium and interest modified the arbitral award by granting benefit of 12% additional compensation to the claimants. Aggrieved by this, the present appeals are preferred by the appellant/NHAI. 8.The learned counsel appearing for the appellant/NHAI would submit that the learned District Judge has granted the benefit of Section 23(1-A) of Land Acquisition Act, 1894 even though no such prayer was made before the Arbitrator nor the arbitrator had granted such a benefit in the Arbitral Award. He would further submit that it is settled law that a litigant cannot be put in a situation worse than what he was prior to approaching the Court and that under Section 34(2) of the Act, the Court has no power to modify the Arbitral Award.

He would further contend that in the case of NHAI Vs. Hakeem (2021 (9) SCC 1] the Hon'ble Supreme Court had categorically reiterated that the Courts have no power to modify the Arbitral Award while exercising its jurisdiction under Section 34 (2) of the Act. Hence, prayed for setting aside the order passed by the learned District Judge.

9.The learned counsel for the respondents would submit that as per the decision in 'Tarsem Singh' by the Hon'ble Supreme Court, the claimants are entitled for 'solatium and interest' under the NHAI Act. However, they would __________Page 36 of 50

fairly concede that the claimants are not entitled for the benefit of 12% additional compensation as provided under Section 23 (1-A) of the land Acquisition Act, 1894.

10.Heard on both sides and records perused.

11.The Hon'ble Supreme Court in Union of India Vs. Tarsem Singh reported in (2009 (9) SCC 304) declared that in acquisition of lands relating to National Highways matters, the land owners are entitled for solatium with interest and the learned District Judge had also confirmed that the land owners are entitled to seek for the said solatium with interest and the same is also accepted on the side of the appellant/NHAI.

12.The only issue to be decided in these appeals is that whether the learned Principal District Judge is justified in granting benefit of 12% additional compensation to the claimants as provided under Section 23(1-A) of the Land Acquisition Act, 1894. The original Section 3 (J) of the National Highways Act barred land owners from receiving any solatium or interest available under the Land Acquisition Act, 1894. In the land mark judgment of Union of India Vs. Tarsem Singh reported in (2009 (9) SCC 304), the Hon'ble Supreme Court stuck down Section 3(j) of NH Act as unconstitutional, specially because it denied land owners the right of solatium __________Page 37 of 50

(Section 23 (2)) and interest (Section 28). While Solatium and interest were mandated to be paid in NHAI Acquisitions, subsequently, the Hon'ble Apex Court clarifications affirmed that Section 23 (1-A) (the Additional 12% amount for the period from the notification to the Award) does not apply to acquisitions undertaken under the National Highways Act. Therefore, 12% additional compensation awarded under Section 23 (1-A) granted by the learned District Judge under NHAI proceedings is unsustainable. 13.Therefore, the land owners are not entitled for any amount under Section 23(1)(A) of the Land Acquisition Act, 1894.

Hence, this Court is unable to concur with the decision of the learned Tribunal Judge in granting the 12% additional value of the amount as per the Section 23(1)(A) of the Land Acquisition Act, 1894, on the basis of the subsequent development of law i.e., subsequently the Hon'ble Supreme Court in National Highway Authority of India and Another Vs. Tehal Singh and Others reported in 2021 SCC Online SC 3175 has clarified that the land loser is not entitled to the compensation under Section 23(1)(A) of the Land Acquisition of the Act, 1894. 14.

is none other than the Deputy Commissioner who has taken note of the market value in the vicinity, has relied on the decision in NHAI vs. M. Hakeem & Anr., (2021) 9 SCC and the decision in Delhi Airport Metro Express Pvt. Ltd. vs. Delhi Metro Rail Corporation Ltd. (2022) 1 SCC 131 to indicate that there should be minimal interference in arbitral awards, save, it suffers from patent illegality.
