Writ Petition filed under Article 226 of the Constitution of India for issuance of a writ of certiorarified mandamus to call for the records in Assessment No.008/021/01454, on the file of the second respondent, 29.03.2018 and quash the same as illegal, incompetent, without jurisdiction and further direct the second respondent to exempt the petitioner from paying property tax in view of Section 83(e) of the District Municipalities Act, 1920.

It is represented by both sides that in pursuant to the impugned demand, a fresh demand notice dated 22.01.2019, is issued calling upon the petitioner to pay only a sum of Rs.5,62,743/- instead of the amount referred to in the impugned proceedings.

2. Learned counsel appearing for the respondents submitted that after giving waiver, the present demand notice dated 22.01.2019 is issued on the petitioner and therefore, if the petitioner pays the said amount, the respondents will not have any objection.

3. Learned counsel for the petitioner submitted that in pursuant to the subsequent demand notice dated 22.01.2019, the petitioner will pay the amount so demanded in the said notice immediately. Therefore, the learned counsel contended that the writ petition may be closed by recording the above said contention.

4. Considering the above stated facts and circumstances and the submissions made by the learned counsel for the respective parties, this writ petition is closed by recording the above said submissions. No costs. The connected miscellaneous petitions are closed.
