Mr.V.Shanmuga Sundar, learned Special Government Pleader takes notice for the respondents. By consent, the writ petition is taken up for final disposal at the admission stage itself.
2. The petitioner has come up with the present writ petition, for a mandamus, directing the first respondent to consider his representation dated 13.07.2018.
3. The case of the petitioner is that the property in Survey No.260/1, measuring to an extent of Acre 5.38 cents at Settipalli Village, Denkanikottai Taluk, Krishnagiri District, was originally allotted to his grand father under Adi Dravidar Scheme. After the demise of his grand father, his father Madhangiriappa has been in possession and enjoyment of the property. However, the UDR patta has been wrongly issued in the name of Thimmarayappa S/o. Marappa in respect of the said property. Hence, the petitioner made a representation dated 13.07.2018 to the respondents 1 to 3, to cancel UDR patta and issue joint patta to the legal heirs of Madhangiriappa. Finding no response on the said representation, the petitioner is before this Court.
4. The learned Special Government Pleader appearing for the respondents submitted that the first respondent is the competent authority to consider the representation of the petitioner and he is ready to consider the same on merits and in accordance with law.
5. Considering the facts and circumstances of the case and having regard to the submissions made by the learned counsel on either side, this Court, without going into the merits of the case, directs the first respondent to dispose of the representation of the petitioner dated 13.07.2018, on merits and in accordance with law, after affording an opportunity of personal hearing to the petitioner as well as all the necessary parties, within a period of eight weeks from the date of receipt of a copy of this order.
