The petitioner/accused prays for the grant of anticipatory bail under Section 438 of Cr.P.C. for offences punishable under Section 498-A IPC on the file of the respondent police.

2.The petitioner is the husband of the defacto complainant.

The case of the prosecution is that the petitioner is alleged to have ill-treated and demanded dowry from the defacto-complainant,resulting in filing of the complaint.

3. The learned Government Advocate (Crl.

Side) submits that petition enquiry is pending in C.Sr.No.236 of 2016. However, he submits that on conclusion of the enquiry, there is possibility of registering the case for cognizable offences. 4.On consideration of the facts and circumstances of the case and as it is informed that C.Sr.No.236 of 2016 is pending and as such, apprehension of arrest is well found, I am of the view that the petitioner can be granted the relief prayed for and accordingly;

(a) In the event of arrest by or on appearance before the respondent police;

(b) In the event of appearance before the learned Judicial Magistrate, Vellore, within 15 days from the date of receipt of copy of the order, (i) the petitioner shall be enlarged on bail on his executing a personal bond for Rs.5,000/- with one surety for the likesum to their satisfaction;

(ii) The petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the fact of the case so as to dissuade him from disclosing such facts to the Court or to any Police Officer; and (iii) The petitioner shall be available for interrogation by the respondent police as and when required.
