This application has been filed by the 2nd and 3rd defendants seeking interference of an order dated 14.03.2022 by which order they had been set ex-parte. In the affidavit filed in support of the Judge's summons, it had been stated that the representation could not be made on 14.03.2022 since the counsel had not noticed the listing of the case. In view of the fact that it is only appropriate that the issues raised by the plaintiff are decided on merits and no advantage accrues to either the plaintiff or the defendant in short-circuiting due process, the ex-parte order dated 14.03.2022 insofar as the 2nd and 3rd defendants alone are set aside. The Application is allowed.
