ORDER : The Court Made the following order :- The petitioners, who were arrested and remanded to judicial custody on 14.03.2021 for the alleged offences punishable under Sections 294(b), 397, 506(ii) of IPC and 20(1) of Cigarette and Other Tobacco Products Act in Crime No.119 of 2021, seek bail.

2. The case of the prosecution is that the on 14.03.2020, the petitioners and another accused were selling banned Tobacco products and compelled the de-facto complainant to buy and when he refused, they threatened him with knife and took away Rs.1400/- from the pocket of the de-facto complainant. Hence the complaint.

3. The learned counsel for the petitioners submitted that the petitioners are innocents and they did not commit any offence as alleged by the prosecution. He further submitted that the petitioners have been in judicial custody since 14.03.2021 and hence, they may be granted bail. https://hcservices.ecourts.gov.in/hcservices/

4. The learned Additional Public Prosecutor would submit that 173 kgs of banned Tobacco products were seized from the petitioners and one previous case is pending against the petitioners. Hence, she vehemently opposed to grant bail to the petitioners.

5. Considering the facts and circumstances of the case and taking into account the nature of allegations made against the petitioners and also the antecedents of the petitioners are reported to be bad, this Court is not inclined to grant bail to the petitioners.
