This application has been filed to condone the delay of 2130 days in filing the proclamation of sale in C.S.No.303 of 2007 order dated 26.04.2018.

2. Heard the learned counsel for the applicant who was the plaintiff in the suit.

3. The learned counsel for the respondent / defendant is also present and he has stated that he has to receive instructions from the defendant.

4. In the affidavit filed in support of the Judges Summons, it had been stated that though the Execution Petition in E.P(Dairy) No.37185 of 2022 had been filed on 06.04.2022, owing to the Covid - 19 pandemic, it could not be taken on file. Thereafter, it had been returned for various compliances. It had been further stated that to process the execution proceedings, the applicant has to produce all the necessary revenue records and in the meanwhile, the properties were under acquisition proceedings and hence, the applicant was not able to proceed further. 5. In view of the above stated reasons, I condone the delay in filing proclamation. Accordingly, this application is allowed.

6. However, the respondent may file an affidavit whether the specific property is subject to eviction or there could be a possibility for the property to be released from the eviction process.
