A. No.1867 of 2024 in C.S. No.520 of 2013 P.B.BALAJI, J., This Application has been taken out by the Applicants to order reconstruction of the written statement filed in O.S. No.520 of 2013 in Diary No.14762 of 2014 which was returned by the Office on 22.04.2014 found misplaced.

2. By order dated 15.04.2024, this Court expressed that the above Application was not maintainable on the face of the record. At the request of the learned counsel for the Applicants, the matter is adjourned today. The 8th defendant also filed counter opposing the said Application. The learned counsel for the plaintiff also states that this Application is not maintainable on the principal ground that what is not before the Court viz., written statement which has not been accepted and cannot form the basis of reconstruction.

3. I am in full agreement with the said objections to order reconstruction of the written statement admittedly, even according to the Applicants, the same has been misplaced. I do not find any reasons to allow this Application and accordingly, this Application is dismissed.
