This application has been filed seeking to condone the delay of 35 days in filing the written statement filed on behalf of the second defendant.

2. In the affidavit filed, it has been stated that the vakalat had been filed on 12.12.2023 even though service was not completed insofar the suit summon was concerned on the second defendant. It is stated that a slight delay had occurred in filing the written statement.

3. Heard the learned counsel for the plaintiff.

4. In view of the fact that the second defendant is the purchaser of the property and necessarily have to be heard during the course of trial, the delay is condoned. Registry to take into consideration the written statement filed by the second defendants.
