PRAYER: Writ Petition filed under Article 226 of the Constitution of India, to issue Writ of certiorarified mandamus, to call for records of the impugned proceeding of the first respondent dated 19.11214 bearing Na.ka.5219/2014/I-2 and quash the same and further issue necessary direction to the first respondent to relieve and discharge the petitioner from Government service as Village Assistant at No.68, Seruthiyur village, Mayiladuthurai Taluk, Nagapattinam District, on the grounds of the health reason.

This writ petition is filed seeking a direction to the respondents to relieve the petitioner from Government service on voluntary retirement scheme as per the request made by him basing on his health condition. There is no representation on behalf of the petitioner. It is brought to the notice of this Court by the learned Government Advocate representing the respondents that as on the time of filing of this writ petition, viz., 2015, the age of the petitioner was 55 years and by now after a lapse of 8 years, he could have attained the age of superannuation. Since the petitioner has already attained the age of superannuation, his request for relieving him under voluntary retirement scheme does not raise.

Accordingly, the relief sought by the petitioner in this writ petition has become infructuous and hence, this writ petition is dismissed as having become infructuous. No costs.
