Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a writ of mandamus directing the Respondents 1 to 4 to disburse/pay/credit the Petitioner's pension with all benefits time to time enhanced, emoluments with interest to the Petitioner's SB A/c No.2510000300136982 maintained with the 5th Respondent. ORDER
The relief sought in this Writ Petition is to direct the Respondents 1 to 4 to disburse/pay/credit Petitioner's pension with all benefits time to time enhanced, emoluments with interest to the Petitioner's Savings Bank Account No.2510000300136982 maintained with 5th Respondent Bank.
2. The brief facts of the case are that the Petitioner's pension was credited in his Bank Account No.2510000300136982 maintained with 5th Respondent Bank till October 2008, but, thereafter, pension was not credited in his Bank Account. When the Petitioner approached the Respondents in this regard, the Petitioner was driven from pillar to post. Hence, the Petitioner has filed this Writ Petition for the aforesaid relief.
3. Today, when this Writ Petition was taken up for hearing, the learned Government Advocate for the 4th Respondent submitted that the Petitioner is in receipt of the arrears of pension from the Respondents. In this connection, the learned Government Advocate for the 4th Respondent 3/6
produced a copy of the State Scroll of December 2024 before this Court which indicates that during the month of December 2024, a sum of Rs.37,616/- had been credited to the Petitioner's Bank Account No.2510000300136982 as pension.
4. Considering the submission made by the learned Government Advocate for the 4th Respondent and the copy of State Scroll December 2024 produced by him before this Court, this Writ Petition is closed. However, liberty is granted to the Petitioner to file a fresh Petition, if the above submission made by the learned Government Advocate for the 4th Respondent is incorrect. No costs. Consequently, connected Miscellaneous Petition is also closed.
