The petitioner who was apprehends arrest at the hands of the respondent police for the offences under Sections 294(b), 323, 341, 506(ii) IPC read with Section 4 of Women Harassment Act, in Crime No.879 of 2022, on the file of the respondent police, seeks anticipatory bail.
2. The case of the prosecution as per the defacto complainant Mariyammal is that due to previous enmity, on 14.10.2022, the petitioner along with other accused, abused her with filthy language and also attacked her son. Hence, the case.
3. The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case due to previous enmity. Hence, he prayed for grant of anticipatory bail to the petitioner.
4. The learned Government Advocate (Crl. Side) appearing for the respondent police vehemently opposed for grant of anticipatory bail to the petitioner stating that the petitioner along with other accused consumed Ganja and attacked the defacto complainant's son due to previous enmity. ksa-2 5.Considering the nature of offence and the fact that the petitioner has got one previous case for the offence under Section 302 IPC, this Court is not inclined to grant anticipatory bail to the petitioner.
