ORDER

The petitioners herein apprehending arrest at the hands of the respondent police for the offences punishable under Sections 303(2) and 326(a) of BNS, 2023 r/w. 21(1) and 21(4) of Mines and Minerals (Development and Regulation) Act, 1957 in Crime No.31 of 2026, on the file of the respondent Police, seek anticipatory bail.

2. The allegation against the petitioners is that the petitioners were found in illegal transportation of 1⁄4 units of river sand without any valid permit or licence. Hence, the complaint.

3. The learned counsel appearing for the petitioner submitted that the petitioners are an innocent persons and they have been falsely implicated in this case. Hence, he prayed for grant of anticipatory bail to the petitioners.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that the 1st petitioner has three previous cases out of which one case is of a similar nature and the 2nd petitioner has two previous cases out of which one is of a similar nature. Hence, he opposed to grant anticipatory bail to the petitioners.

5. I have given anxious consideration to the submissions made by the learned counsel on either side.

6. From the submission of the learned counsel on either side, this Court is of the view that the petitioners have criminal antecedents, hence, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original petition is dismissed.
