Application No. 2559 of 2024 in C.S. No. 169 of 2023 C.V.KARTHIKEYAN, J.

This application has been filed seeking to condone the delay of 133 days in filing written statement.

2. In the affidavit filed in support of the application of judges summons, it had been stated that the copy of the plaint alone was received and thereafter, application had to be filed for copies of the documents. In the meanwhile, the matter was referred to the mediation centre and in all these processes, there was a delay.

3. Heard the learned counsel for the plaintiff also.

4. It is the grievance of the learned counsel for the plaintiff that this is the second round of litigation, but that is an issue which has to be examined during the course of trial.

5. Taking into consideration the reasons given, the application stands allowed and the delay is condoned.
