The learned counsel for the revision petitioner would

submit that the revision petitioner has filed the present Civil Revision Petition before this Court challenging the order passed by the learned Subordinate Judge, Udhagamandalam, The Nilgiris in CMA.No.2 of 2017. The Appellate court has dismissed the appeal on the ground that the appeal is not maintainable.

2. From the above facts, challenging the order passed by the trial court, the appeal is not maintainable. However, liberty is granted to the revision petitioner to challenge the same before the appropriate forum.

3. The Civil Revision Petition is disposed of with above direction. Consequently, the connected miscellaneous petition is closed. No costs. The Registry is directed to return the original certified copy of the order passed in CMA.No.2 of 2017 to the counsel for the revision petitioner after obtaining a copy of the same. 30.01.2018 Speaking/Non-Speaking order Index :Yes/No Internet:Yes/No lok Note: Issue order copy on 31.01.2018
