This application has been filed by the applicant/defendant to condone the delay of 14 days in filing the application to set aside the exparte order dated 13.08.2013 made in C.S No.751 of 2010.

2.The learned counsel for the respondent/plaintiff has strongly opposed to allow this application.

3. Having satisfied with the reasons stated in the affidavit filed in support of the application and in order to give a fair opportunity to the applicant/defendant to contest his case on merits, the delay is condoned and accordingly, this application is allowed.

4. Post the main suit on 24.09.2024.
