Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the 1st respondent and 2nd respondent to take necessary action and pass appropriate orders on the enquiry conducted by the 2nd respondent based on the representation of the petitioner dated 13.5.2013 and communication of the 2nd respondent dated 10.1.2014 to the 3rd respondent forthwith.

By consent the writ petition is taken up for final disposal. 2.The petitioner in an earlier occasion filed W.P.No.23249 of 2014 praying for issuance of writ of mandamus directing the first respondent therein, namely, The Commissioner, Disaster Management, Ezhilagam, Chepauk, Chennai and the second respondent who is arrayed as first respondent herein to take necessary action against the erring officials based on departmental action and also initiate civil and criminal based on the representation dated 13.05.2015. The Hon'ble First Bench of this Court vide order dated 27.08.2014,

passed an order stating that the concerned authorities particularly third respondent are expected to take expedite steps in this regard. 3.The learned counsel appearing for the petitioner would submit that thereafter, the second respondent has conducted enquiry and forwarded a report to the first respondent and thereafter nothing has been heard and hence came forward to file this writ petition. 4.The petitioner has also sought information under the Right to Information Act and the office of the second respondent has informed vide memo dated 31.12.2014 stating that the files are pending before the first respondent.

5.Learning counsel appearing for the petitioner would submit that it would be suffice to direct the first respondent to pass orders at an early date.

6.This Court heard the submissions of Mr.C.Prabakaran, learned counsel appearing for the petitioner and Mr.V.Subbiah, learned Special Government Pleader who accepts notice on behalf of the respondents 1 to 3.

7.Though the petitioner prayed for a larger relief, this Court in the facts and circumstances of the case and without entering upon the merits of the claim projected by the petitioner, directs the first respondent to act on the grievance expressed by the petitioner after putting the respondents 4 and 5 on notice and pass orders as expeditiously as possible not later than eight weeks from the date of receipt of a copy of this order and communicate the decision taken, to the petitioner as well as to the private respondents.
