This writ petition is filed seeking a mandamus to direct the second and the third respondents to revise and regularize the service and to fix the seniority and give the notional promotion with monetary benefits equal to the post of Sub-Inspector of Police rank to the petitioner on the basis of the petitioner's representation dated 06.01.2015. There is no representation on behalf of the petitioner. Learned Special Government Pleader appearing on behalf of the respondents submitted that a detailed counter has already been filed and submitted further that the petitioner who was working as a Grade I Police Constable was upgraded as Head Constable on 14.01.1998 and later the Government has issued a Government Order in G.O.Ms.No.937, Home (Police-3) Department dated 21.07.1998 basing on which a person who has served for ten years as Head Constable alone were eligible for upgradation to Page No.2 of 4

the post of Special Sub-Inspector of Police (SSI). It is further submitted that the petitioner even prior to the completion of ten years of service had attained the age of superannuation on 30.06.2007 thereby he is not entitled for any relief sought for.

When this matter was listed on an earlier occasions, i.e., on 01.11.2023 and 09.11.2023 the petitioner has not appeared either in person or through his counsel. It appears that the petitioner is not interested to prosecute this case any more.

Considering the same this writ petition is dismissed for nonprosecution. Costs made easy. 15.11.2023 vca To:
