This application has been filed seeking to condone the delay of 333 days in filing the written statement.

2. The learned counsel for the respondent/ plaintiff would contend that the delay has not been properly explained and the defendants have been watching the proceedings from day one and had entered appearance only after publication was made.

3. Considering the averments made in the affidavit filed in support of the application and the fact that the suit has been filed for recovery of Rs.1,41,36,715/-, I consider it appropriate to give an opportunity to the defendants to defend the suit.

4. Hence, this application is allowed subject to the condition that the applicant pays a sum of Rs.3,000/- (Rupees Three Thousand http://www.judis.nic.in
