ORDER

This Criminal Original Petition has been filed, seeking to quash the First Information Report in Crime No.676 of 2025, dated 17.11.2025 and the consequential Alteration Report on the file of the Inspector of Police, Tambaram Railway Police Station, Chennai, wherein the petitioner has been arrayed as A2 for the alleged offence under Section 194 of BNSS, 2023.

The learned counsel for the petitioner submitted that the petitioner is a senior officer serving as Branch Manager at the Metropolitan Transport Corporation, Tambaram Depot, and has been discharging his official duties strictly in accordance with the service rules and administrative regulations. In such circumstances, the deceased B.Yuvaraj, a Junior Engineer at the same Corporation, allegedly committed suicide by falling in front of a moving train on 17.11.2025. Prior to the incident, the deceased is said to have sent an e-mail to the Police authorities, stating that his leave request has been rejected by the petitioner and one Swarnalatha from the HRD Department, and that such rejection along with consequent salary cut, caused him mental agony, leading him to take the extreme step. The said e-mail is the sole material relied upon by the respondent police to implicate the petitioner.

The learned counsel for the petitioner contended that the rejection of leave and communication of procedural requirements were purely administrative acts performed in discharge of official duty and cannot, by any stretch of imagination, amount to abetment of suicide. He further submitted that there is no allegation of any direct or indirect act of incitement, continuous harassment on the part of the petitioner. Mere naming of a superior officer in a suicide note, without any positive act or proximate conduct amounting to instigation, would not constitute abetment in the eye of law. Hence, the present petition has been filed, seeking quashment of FIR and Alteration Report.

The learned Additional Public Prosecutor for the first respondent produced the suicidal note of the deceased B.Yuvaraj, wherein it is stated that, in the event of him taking any extreme step, the petitioner and the said Swarnalatha would be responsible for his death. Further, the Whatsapp communications have been collected, and the electronic evidence prima facie indicates that the messages originated from the deceased. It was also submitted that the investigation is in progress.

5. Heard the learned counsel for the petitioner and the learned Additional

Public Prosecutor for the first respondent and also perused the materials available on record.

Considering the submission made by the learned counsel on either side and upon examining the facts and circumstances of the case, this Court finds that prima facie materials are available against the petitioner. When a suicide note exists, its veracity cannot be adjudicated in a petition for quashing. Accordingly, this Criminal Original Petition stands dismissed. Consequently, connected Miscellaneous Petition is closed.
