This Criminal Original Petition has been filed to direct the respondent to register the complaint of the petitioner in CSR No.153 of 2002 dated 20/3/2022.
2. Heard Ms.S.Sujatha, learned counsel for the petitioner and Mr.A.Gokulakrishnan, learned Additional Public Prosecutor for the respondent.
3. If the Police has not registered the First Information Report, the petitioner has to follow the procedure contemplated under Section 154 of the Code of Criminal Procedure. Even if the same has not been materialised, there is no bar for initiating the prosecution by filing a private complaint under Section 200 of the Code of Criminal Procedure. https://hcservices.ecourts.gov.in/hcservices/
4. In such a view of the matter, this Court cannot direct the respondent to register the First Information Report, as a matter of right, unless the case comes within the ambit of a rare case.
5. Accordingly, this Criminal Original Petition is dismissed. Liberty is granted to the petitioner to work out his remedy as per law.
