A.No.3788 of 2024 in C.S.No.696 of 2003 ABDUL QUDDHOSE, J It is brought to the notice of this Court by both the learned counsels that the Division Bench of this Court had granted stay in respect of passing of a final decree. Therefore, A.No.3788 of 2024, which has been filed seeking for passing of a final decree to allot 1/4 share in the suit Item No.1 property by metes and bounds to Mrs.N.Sakunthala has to be closed to await the outcome of the decision to be rendered in the Original Side Appeal. Accordingly, A.No.3788 of 2024 is closed. However, liberty is granted to the applicant to revive the application seeking for passing of a final decree in case the applicant succeeds in the original side appeal.
