ORDER

This application has been filed to appoint an Advocate Commissioner along with a Chartered Engineer to identify the divisibility of item 1 suit property and thereby file a report before this Court.

2. On 29.11.2024, this Court has appointed an Advocate Commissioner to file a report as to whether the Item No.1 of the suit schedule property is divisible or not with the assistance of the Charted Engineer. Thereafter, the

Advocate Commissioner has filed his report on 27.03.2025.

3. When the matter is take up today the respondents 1, 3 to 5 have filed objection to the Commissioner's Report. Hence, this Court feels that the proceedings relating to the Advocate Commissioner can be closed.

4. It is learnt that the other application in A.No.3788/2024 was already closed on 22.11.2024 by giving liberty to the parties to reopen the same depeding upon the outcome of the O.S.A.Nos.99 & 100 / 2024 challenging the preliminary decree.

5. In the result, this application filed to appoint the Advocate Commissioner, is closed.
