Respondent PRAYER: Criminal Original Petition filed under Section 439 (1) of Cr.P.C., praying, to modify the condition that Para No.1 "the petitioner/accused No.2 & 3 are ordered to be released on bail on his executing a bond for a sum of Rs.10,000/- along with two sureties in which one surety must be blood surety and the sureties shall produce solvency certificate which is issued by not below the rank of Tahsildhar & sureties shall produce their aadhaar card or Bank Pass Book" vide order dated 04.03.2020 in Crl.M.P.No.1419 of 2020 on the file of the Judicial Magistrate, Avinashi.

O R D E R

This modification petition has been filed seeking to modify two conditions imposed by the Court below, viz., directing the petitioners to get solvency certificate from the Tahsildhar and directing the petitioners' one blood relative to execute the sureties.

2. The learned counsel for the petitioners submitted that the petitioner will comply with all the other conditions and due to the prevailing circumstance, the petitioners are not in a position to comply with the above said conditions.

3. Heard the learned Additional Public Prosecutor appearing on behalf of the respondent police.

3. Taking into consideration the facts and circumstances of the case and the prevailing situation, the condition imposed by the Court below is modified to the extent that the petitioners shall execute a bond for a sum of Rs.10,000/- each with two sureties for a like sum. The other conditions imposed by the Court below shall stand unaltered.

4. This petition is disposed of accordingly.
