This criminal original petition has been filed to pass an order of direction, directing the respondents not to harass the petitioner without due processes of law till his name is removed from Array of History Sheet, on the file of the 2nd respondent herein to secure the ends of justice. O R D E R

The learned counsel for the petitioner submitted that the petitioner is being harassed by the respondent police and is being called for enquiry without even issuing a summon. The learned counsel further submitted that earlier, the petitioner was branded as a history sheeter and the same was challenged by the petitioner before this court and orders have also been passed by this court. The learned counsel submitted that if at all the respondent wants to conduct an enquiry, a summon should be issued to the petitioner.

The learned Additional Public Prosecutor, on instruction, submitted that proceedings under Section 110 of the Code of Criminal Procedure has been initiated againgt the petitioner and he will be issued summons before calling for the enquiry.
