ORDER
The petitioner herein apprehending arrest at the hands of the respondent police for the offences punishable under Sections 303(2) of BNS, 2023 r/w. 21(1) and 21(4) of Mines and Minerals (Development and Regulation) Act, 1957 in Crime No.76 of 2026, on the file of the respondent Police, seek
anticipatory bail.
2. The allegation against the petitioner is that the petitioner was found in illegal transportation of 2 units of gravel sand without any valid permit or licence. Hence, the complaint.
3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. Hence, he prayed for grant of anticipatory bail to the petitioner.
4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that there is one previous case of a similar nature pending against the petitioner. Hence, he opposed to grant anticipatory bail to the petitioner.
5. I have given anxious consideration to the submissions made by the learned counsel on either side.
6. From the submission of the learned counsel on either side, this Court is of the view that the petitioner has criminal antecedents, hence, this Court is not inclined to grant anticipatory bail to the petitioner.
7. Accordingly, this Criminal Original petition is dismissed. 13-03-2026 MPA To 1.The Inspector of Police, Karimangalam Police Station, Dharmapuri District.
