O R D E R

The petitioners apprehend arrest for the alleged offence under Sections 126(2), 296(b), 115(2), 118(1), 351(3) of Bharatiya Nyaya Sanhita, 2023 in Crime No.55 of 2026 on the file of the respondent police seek anticipatory bail. 1/4

The case of the prosecution is that on 10.02.2026 at about 04.00 P.M., while the defacto complainant and his friends were standing near a shop, the petitioners came in a two wheeler, picked up quarrel with them, uttered abusive words, attacked them with a pipe and caused injuries. Hence, the case was registered.

3. The learned counsel appearing for the petitioners submitted that the petitioners are innocent and have been falsely implicated in this case without any basis. It is submitted that there is no specific overt act attributed against the petitioners and the petitioners are ready to cooperate with the investigation and they will appear before the respondent police as and when required. The learned counsel would further contend that the petitioners will not abscond or tamper with witnesses and are ready to abide by any condition imposed by this Court. Hence, he prayed for granting anticipatory bail to the petitioners.

4. The learned Government Advocate (Crl. Side) appearing for the respondent submitted that there are totally three accused in this case and the petitioners are ranked as A1 and A3. He further submitted that the petitioners along with other accused attacked the victim with a pipe and caused injuries and the victim was admitted in the hospital for two days. It is further submitted that the petitioners have no three previous cases against him. He further submitted that 2/4

the second petitioner/A2 bail petition was dismissed by this Court in Crl.OP.No.6629 dated 16.03.2026. Hence, he prayed for dismissal of the anticipatory bail.

5. I have given my anxious consideration to either side submissions.

From the submissions made by the learned Government Advocate (Crl.Side), it is seen that the bail application filed by the co-accused/A2 was dismissed by this Court and considering the nature and the gravity of the offence, this Court is not inclined to enlarge the petitioner on anticipatory bail.
