The Transfer Petition is filed to withdraw FCOP.No.127 of 2022 pending on the file of the Family Court, Namakkal and to transfer the same to the file of the Sub Court, Sankari.
2. The petitioner would submit she has to travel from Salem to Namakkal to attend every hearing. She would submit that she does not have any independent income and is dependent on her parents. She would further submit that it is very difficult for her to travel from Salem to Namakkal with her 2 year old child to attend the hearing. Therefore, the transfer petition.
3. The respondent though served has not entered appearance.
4. Considering the fact that the petitioner has to attend every hearing as the matter is pending before the Family Court for which 2/5
purpose she has to travel from Salem to Namakkal and the fact that she has not been receiving maintenance, the transfer petition is allowed as prayed for. Further the matter is being transferred to a Subordinate Court, where the presence of the parties for every hearing is not compulsory. Therefore, the respondent is not prejudiced in any manner. Consequently, the connected miscellaneous petition is closed. No costs.
