Road, Anumanthaputheri, Chengalpet, illegally used by the residents of the adjacent properties in accordance with law within the time that may be fixed by this Court. For Petitioner:

ORDER
This Writ Petition is filed seeking direction to the second and fifth respondents to consider the petitioner's representation dated 20.01.2025, to conduct enquiry and give opportunity to petitioner to state his case and produce documents in support of his contentions and to issue direction to remove the open drainage located on the northern side of the petitioner's property situated at No.45/15, 1st street, G.S.T. Road, Anumanthaputheri, Chengalpet, illegally used by the residents of the adjacent properties.

The learned counsel for the petitioner would submit that the petitioner is an absolute owner of the property situated at Ward No.V, Melamiyur, Anumanthaputheri, Chengalpattu Town, Chengalpattu District. Despite obtaining necessary building approval by the petitioner, the construction is obstructed by his neighbours, including fifth respondent, due to the unauthorised and unapproved open drainage system on the northern side of the petitioner's property. The learned counsel further submits that due to the open drainage system, which directs sewage water from neighbouring houses, poses a significant health risks, the petitioner has taken steps to address the issue by lodging a police complaint. He also made a representation on 20.01.2025 to the respondent. However, there is no response till date. Hence, the petitioner has preferred the Writ Petition.
3. Mr.N.Naveen Kumar, learned Government Advocate, entered appearance for R1 to R3, Mr.S.Rajesh, learned Government Advocate, entered appearance for R4 and M/s.Shakila Banu, learned Standing Counsel appeared for fifth respondent.
4. Learned Government Advocate appearing for the fourth respondent would submit that the representation of the petitioner dated 20.01.2025 will be considered in accordance with law and appropriate orders will be passed within a specific time that may be stipulated by this Court.
5. Considering the submissions made by the learned counsel appearing on either side, without going into the merits of the case, this Court directs the fourth respondent to consider the representation of the petitioner dated 20.01.2025 after giving notice to the petitioner as well as sixth respondent, affording an opportunity of personal hearing and pass appropriate orders on merits and in accordance with law, within a period of eight weeks from the date of receipt of copy of this order.
