The present application is filed by the applicant / plaintiff to condone the delay of 394 days in filing the petition to set aside the order of dismissal dated 29.01.2021 in T.O.S.No.14 of 2007 to restore the same on file and to decide the same on merits based on the consent affidavit filed by the contesting respondent.

2. Heard both sides.

3. Being satisfied with the reasons stated in the affidavit filed in support of this application, particularly at Paragraph Nos.2 and 3 and taking into consideration of the fact that though there is no serious objection raised by the respondents, this Court hereby directs the applicant / plaintiff to pay a sum of Rs.500/- [Rupees Five Hundred only], as cost, to the Advocate Clerk's Association on or before 15.05.2022.
