Both the writ petition filed under Article 226 of the Constitution of India to issue a writ of mandamus directing the respondents to revise the petitioners' wages with effect from 01.09.2016 based on the 13th wage settlement dated 04.01.2018 and pay him the difference in Leave Salary and Gratuity along with interest at the rate of 12 % per annum from the date of entitlement to till the date of actual disbursement within a time limit to be stipulated by this Hon'ble Court For Petitioner(s):

ORDER
This writ petition on hand has been filed for the following relief:- " praying for issuance of a writ of mandamus, directing the respondents to revise the petitioners' wages from 01.09.2016 based on the 1eth wage settlement dated 04.01.2018 and pay the difference leave sary and gratuity along with interest at 12% per annum from the date of entitlement till the date of actual disbursement.
2. The case of the petitioners is that they were working as Special Grade Conductor and retired from service on 31.10.2016. According to Clause I of the terms of settlement under Section 12(3) of the Industrial Dispute Act, as per 13th Tripartite wage Settlement, employees who were in service as on 01.09.2016 are eligible for revised wages. Hence, the petitioners are covered under the 13th wage settlement.
However, the respondents settled the retirement benefits of the petitioners based on the pre-revised wages. Subsequently, pursuant to the wage revision implemented from November 2019, the respondents are bound to pay the difference in gratuity and leave salary. In this regard, the petitioners submitted a representation on 0.02.2026 to the respondents to pay him the differential payment with interest. However, the same had not been considered to date by the respondent. Hence, the petitioner is before this Court.
3. Heard the learned Counsel on either side and perused the records.

Considering the limited request of the petitioner and taking note of the fact that the petitioner's representation has not been considered to date by the respondent, a mandamus, is therefore, issued to the respondent to pay the eligible differential sum of Gratuity and Leave Encashment benefits to the petitioner based on the Grade Pay revised with effect from 01.09.2016 as claimed for, from the said date of entitlement to till the date of actual disbursement, along with admissible interest if any, within a period of four weeks from the date of receipt of a copy of this order.
5. Accordingly, this Writ Petition is disposed of. There shall be no order as to costs.
