ORDER

This criminal original petition has been filed seeking a direction to the respondents to register a case based on her statement recorded on 17.06.2016 by the Police and to conduct investigation in accordance with law.

2. The learned counsel appearing for the petitioner submitted that the petitioner was injured and also, produced copies of the Hospital Records.

3. The learned Additional Public Prosecutor appearing for the respondents submitted that based on the complaint lodged by the petitioner, petition enquiry is pending in CSR.No.85 of 2016 and he further submitted that the petitioner was summoned twice, but, she did not appear, which was refuted by the learned counsel for the petitioner.

Under such circumstances, the first respondent police is directed to conduct enquiry expeditiously and during the course of enquiry, if any cognizable offence is made out, a regular case shall be registered, following the decision laid down by the Hon'ble Supreme Court in Lalita Kumari v. Government of Uttarpradesh and Others reported in (2014) 2 SCC 1, otherwise the petition may be closed under intimation to the petitioner. With the above directions, this Criminal Original Petition is closed.
