This Civil Miscellaneous Petition has been filed seeking to pass an order to take substituted service by effecting publication in a Tamil Daily Malai Murasu as against the 6th respondent for the hearing to be fixed by this court.
2. Mr.J.Srinivasa Mohan, learned counsel for petitioner/appellant appeared and submitted that the notice sent to 6th respondent in the above Second Appeal was returned with an endorsement "Addressee left without intimation" and to that effect, he has already submitted the returned cover. Hence, he filed the present petition praying to permit him to take substituted service by effecting publication.
3. Mr.S.Kaithaimalai Kumaran, learned counsel for respondents 3 to 5 appeared and submitted that he has no objection in allowing this petition.
4. Considering the facts and circumstances and on considering submissions of learned counsel for petitioner, in the interest of justice, this petition is allowed and the petitioner is permitted to take substituted service by way of paper publication on the 6th respondent in anyone of a Tamil daily having wide circulation in the locality at Tiruvannamalai stating that the above Second Appeal will be taken up for hearing on 20.11.2024. 14.10.2024 rpp
