PRAYER: This writ petition is filed under Article 226 of Constitution of
India, to issue a Writ of Mandamus, directing the 2nd and 3rd respondents to make an enquiry relying upon the fraudulent documents executed by the 4th respondent and to prosecute according to the Section 83 of Registration Act, 1908 within stipulated period fixed by this Court. O R D E R
This writ petition has been been filed, directing the 2nd and 3rd respondents to make an enquiry relying upon the fraudulent documents executed by the 4th respondent and to prosecute according to the Section 83 of Registration Act, 1908 within stipulated period fixed by this Court.
2. The learned counsel for the petitioner would submit that this Court may be pleased to permit the petitioner to approach a competent civil court challenging the registered sale deed dated 10.06.2004 vide document Nos.999 of 2004 and 1000 of 2004 and the period during which the matter was pending before this Court may be excluded for the purpose of calculating the limitation.
3. In view of the limited request made by the petitioner, this Court is inclined to direct the petitioner to approach a competent civil court challenging
the above sale deed dated 10.06.2004 vide Document Nos.999 of 2004 and 1000 of 2004 and the period during which the matter was pending before this Court is excluded for the purpose of calculating the limitation.
