Writ Petition filed under Article 226 of the Constitution of India for the relief of issuance of Writ of Mandamus, directing the respondents to pass orders on the statutory appeal dated 04.01.2015 on merits and within a time to be stipulated by this court. ORDER
The petitioner is a Sub Inspector of Police. The next avenue of promotion is to the post of Inspector of Police. While so, he was issued with a charge memorandum on 18.03.2014 under Rule 3(a) of The Tamil Nadu Police Subordinate Services [Discipline and Appeal] Rules, 1955, alleging that he had brought disrepute to the department. The petitioner submitted his explanation refuting the charges. Not satisfied with the explanation offered by the petitioner, the 2nd respondent by his order dated 13.11.2014 imposed a punishment of postponement of increment for three years without cumulative effect. Aggrieved over the same, the petitioner preferred a statutory appeal on 04.01.2015 to the 1st respondent. Now, the grievance of the petitioner is that the above said statutory appeal has not so far been considered and the same is pending. Hence, seeking appropriate direction for the early disposal of the statutory appeal, the petitioner has come up with this writ petition.
