The petitioner was a depositor in Dugar Finance I Limited which was ordered to be wound up by an order dated 08.08.2002. Pursuant to which the office of the Official Liquidator has issued notice to the creditors to file their claim statements as early as 25.11.2011. The petitioner was called upon to furnish the original documents.

2. According to the petitioner, the original was given to the company for payment. However, in the mean time, the company was ordered to be wound up and therefore originals were not available with the petitioner. Thus, there has been a delay.

3. The Official Liquidator submits that after settling the above claims, there are surplus amount still lying with the office of the Official Liquidator which can be distributed to the petitioner after adjudication provided the petitioner substantiate that had indeed deposited amounts with the said company under liquidation.

4. Being satisfied with the reasons stated in the affidavit, Court is inclined to condone the delay. Under these circumstances, applicant/petitioner is permitted to file relevant documents and application within a period of four weeks from today. 13.10.2023 jas
