Sasitharan and refund the said amount of Rs.5,71,601 /- to the petitioner forthwith and not release the death benefits and terminal dues of said deceased Sasitharan to his legal heirs without first settling the petitioners claim in full.

ORDER
The writ petition has been filed for the following relief: "directing the Respondents 1 and 2 to recover the Total Sum of Rs. 5,71,601/- from the death benefits, terminal dues Provident fund, Gratuity and other amounts due and payable to the legal heirs of deceased Mr.S. Sasitharan and refund the said amount of Rs.5,71,601 /- to the petitioner forthwith and not release the death benefits and terminal dues of said deceased Sasitharan to his legal heirs without first settling the petitioners claim in full."
2.When the matter was taken up for hearing, it is brought to the notice of this Court, that the petitioner has already filed a writ petition in W.P.No.33398 of 2024 seeking a declaration declaring the actions of the respondents as illegal and unjust and to direct the respondent to furnish the details of the loan amount obtained by the husband of the fourth respondent herein. The said writ petition is pending before this Court. While so, the petitioner has come forward with this
writ petition seeking the very same relief.
3.Heard the learned counsel on either side and perused the materials available on record.
4.Since for the very same relief, there is a writ petition already pending before this Court, it is well open to the petitioner to file an appropriate application in that writ petition which has been already pending instead of filing a writ petition.
Accordingly, this writ petition is dismissed with a liberty given to the petitioner to file an appropriate miscellaneous petition in the earlier writ petition. Consequently, connected miscellaneous petition is closed. No costs. 23-03-2026 Index: Yes/No Speaking/Non-speaking order ssa
