Respondent Prayer : Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure to direct the respondent to register a case against her Vendor Mr.Subramani and the entire family members of Mrs.Bhanumathi Perumal under the Land Grabbing Act and Punish them according to law as per her complaint dated 01.06.2016 and which was acknowledged by the Respondent police vide CSR No.372 of 2016 dated 25.06.2016 and further direct the respodnent police to make necessary arrangements to restore her common right of Pathway on the Northern Side of her house running from South to North, having a width of 4.5.fts and a length of 69 fts, as per her Sale Deed dated 24.02.1999. ORDER

This criminal original petition has been filed seeking a direction to the respondent to register a case on the basis of the complaint given by the petitioner dated.01.06.2016.

2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the respondent.

3. The learned Additional Public Prosecutor submitted that based on the complaint lodged by the petitioner, the petition enquiry is pending in CSR.No.372 of 2016 before the respondent. https://hcservices.ecourts.gov.in/hcservices/

4. Recording the submission of the learned Additional Public Prosecutor, the respondent police is directed to conduct enquiry expeditiously and during the course of enquiry, if any cognizable offence is made out, a regular case shall be registered, following the decision laid down by the Hon'ble Supreme Court in Lalita Kumari v. Government of Uttarpradesh and Others reported in (2014) 2 SCC 1, otherwise the petition may be closed under intimation to the petitioner.

With the above directions, this Criminal Original Petition is closed.
