This Company Application has been filed to set aside the rejection of the claim petition filed by the petitioner in Form No.69 on 15.05.2019.
2. The learned Deputy Official Liquidator's office has rejected the claim of the applicant herein, on the ground, the original of the FD was now available. Records however reveal that the applicant had approached the Consumer Forum, Chittoor in C.D.No.16 of 1999 on account of the failure of the company under liquidation in respect of FD.Nos.80855 and 80856 of Rs.15,000/- each.
3. Although the case of the applicant in C.D.No.16 of 1999 was rejected, the applicant succeed before the State Commission in F.A.No.46 of 2001.
4. Considering the same, rejection of the claim of the applicant before the office of the Official Liquidator cannot be justified.
5. Under these circumstances, this Company Application is allowed. Consequently, the office of the Deputy Official Liquidator is directed to place the claim petition of the applicant. 22.03.2024 jas
