O R D E R

(The case has been heard through video conference) This Criminal Original Petition has been filed to enlarge this petitioner on bail in the event of his arrest in Crime No.951 of 2015 on the file of the respondent police/Sub-Inspector of Police, Dharapuram Police Station, Dharapuram.

2. The case of the prosecution is that the petitioner while working as a Court Staff joined with an Advocate Clerk had committed the theft of pro-note documents from the Court records.

3. The learned counsel for the petitioner would submit that the respondent Police has registered a false case against the petitioner and he has not committed any offence as alleged by the prosecution.

4. The learned Additional Public Prosecutor would submit that the petitioner is a retired Court Staff and the First Information Report was registered in Crime No.951 of 2015 as per the proceedings of the Hon'ble Court in ROC.No.385/2015VC ROC 430/2018 VC; https://hcservices.ecourts.gov.in/hcservices/

C.No.41/2015 dated 20.10.2015. He would further submit that the investigation is pending in this case and the custodial interrogation of the petitioner is required.

5. Taking into consideration of the facts of the case and the nature of offence committed by the petitioner and the petitioner being a Court Staff alleged to have committed such an offence, this Court is not inclined to grant Anticipatory Bail to the petitioner.
