PRAYER: Writ Petition is filed under Article 226 of Constitution of India, pleased to issue a Writ of Mandamus, to direct the respondents to grant permission and Police protection to conduct a cultural programme (Dance and Music program) in the Panguni Uthara festival to be held on 31.03.2023 from 6.00 pm at Sri Valli Devaseena Sivasubramaniya swamy Thirukovil, situated at Puthukuraipettai Village, Vridhachalam Taluk, Cuddalore District scheduled to be held on 31.03.2023 from 6.00 P.M to 11.00 P.M. The Writ Petition has been filed to direct the respondent to grant permission to conduct cultural Programme (Adal Padal Nigalchi) in the event of Panguni Uthara festival at Sri Valli Devaseena Sivasubramaniya swamy Thirukovil, situated at Puthukuraipettai Village, Vridhachalam Taluk, Cuddalore District, on 31.03.2023, at 6.00 P.M. onwards by considering the petitioner's representation dated 15.03.2023. 2.The learned counsel appearing for the petitioner submitted that in order to conduct the cultural programme in the event of Panguni Uthara festival at Sri Valli Devaseena Sivasubramaniya swamy Thirukovil, situated at Puthukuraipettai Village, Vridhachalam Taluk, Cuddalore District, on 31.03.2023, the petitioner has sent a representation, dated 15.03.2023 to the respondent Police. But, the same has not been considered so far. Hence, the present writ petition has been filed.
3.The learned Government Advocate (Criminal side) appearing for the respondents submitted that the respondent police has received the
representation of the petitioner and the same is pending for consideration. 4.I have considered the submission of the learned counsel appearing for the petitioner and the learned Government Advocate (Criminal side) appearing for the respondent/Police.
5.It is brought to the notice of this Court that the Director General of Police, Tamil Nadu, Chennai, had issued a Circular Memorandum in Rc.007301/Genl.I(1)/2019, dated 09.04.2019, along with instructions to the Inspectors of Police throughout Tamil Nadu for consideration of applications seeking permission for conducting cultural programme. Therefore, in view of the detailed circular and guidelines issued by the Director General of Police, the respondent police is hereby directed to consider the representation of the petitioner, dated 15.03.2023 and pass suitable orders based on the above said circular.
6. With the above direction, this Writ Petition is disposed of. No costs.
